This past September, a driver in a stolen semi-truck led California Highway Patrol officers on a high-speed chase for several hours. The truck, which belonged to a company responsible for the transport of hazardous materials, was reported stolen at 6:30 AM on September 13, 2016. Luckily, the police were able to take the suspect down before he caused any serious injury or damage – though he deactivated the GPS tracking mechanism in the vehicle, they were able to track it through secondary systems.
The story does raise a pretty alarming question, though – what happens if you’re injured by a semi truck, but the person driving it doesn’t work for the trucking company? Who’s liable if you or a loved one is wounded or killed by a stolen vehicle? After all, these trucks don’t stop being dangerous just because they’re being driven by an unauthorized individual.
Had the company in the above story not had the proper measures in place – had they not equipped their truck with tracking mechanisms – there’s a good chance the thief could have seriously hurt someone. And the fact is that most trucking companies aren’t going to be so cautious or conscientious. The companies that cut corners and do things in half-measures might report their trucks stolen and leave it at that.
The key here is tied primarily to how the theft happened. If the trucking company in question practised proper safety and security standards and equipped their vehicles with tracking systems, then they might not be liable for the damages caused by a thief. If, on the other hand, it can be proven beyond a reasonable doubt that the theft was easily preventable, there might well be a case.
